Shipping Policy.

  1. Old Town Tequila does not ship to A.P.O, F.P.O or P.O. boxes under any circumstances.
  2. Old Town Liquor will arrange shipment on behalf of the buyer, to an address furnished by the buyer that will not subject the seller to any sort of legal actions, or if there are any taxes imposed by the state where the delivery address is located.
  3. Spillage/Leaks, minor damage and/or cosmetic defects are all possible to occur during transit. Old Town Tequila does not take responsibility for minor damage.
  4. The taste of the contents within each bottle may vary due to factors such as individual palate differences, aging, storage conditions, and natural ingredient variations. While Old Town Tequila is committed to offering high-quality products, we make no guarantees or warranties regarding the flavor, aroma, or overall taste experience. By purchasing or consuming our products, you acknowledge and agree that Old Town Tequila is not responsible for personal taste preferences, expectations, or dissatisfaction related to the taste of the contents.
  5. Shipping Insurance is included with the shipping fees for all shipments.
  6. If the package is returned due to failed delivery, items are subject to a ten percent (10%) restocking fee will be deducted from your refund. Shipping costs will also not be refunded.
  7. You must be at least 21 years of age to order and a signature of someone at least 21 years of age is required upon delivery.
  8. The customer is solely responsible for the shipment of alcohol and must abide by their local and state laws.
  9. Please note that product images are for illustration purposes only, as labels and bottle shapes may change without notice due to updates by the manufacturer or distiller. We ship the latest version received from the importer or distributor, so the bottle you receive may differ slightly from the image shown.

All orders placed Monday through Friday will be shipped out within 1-5 business days. Although if the item is not currently in stock, shipment may be delayed.

Orders placed on Friday after business hours, Saturday or Sunday will be shipped out within 1-5 business days from the following Monday. Although If the item is not currently in stock, shipment may be delayed.

Orders placed with an engraving add-on selected will take up to 2-4 business days longer than non engraved bottles. So please take that into account when ordering.

NOTICE that during the holidays and busy seasons packages may be delayed. We highly encourage you to place orders early keeping in mind possibilities of delays.

Purchase of Alcoholic Beverages.

By placing your order, you have represented to Old Town Tequila you are at least 21 years old and are giving 100% consent to Old Town Tequila to charge your payment method for the total amount of your order.

Once an order is placed, any address change request must be made promptly. We recommend you call (619)-291-4888. Old Town Tequila will make a good faith effort to accommodate such requests but makes no guarantee such address change can be accomplished. All fees and costs associated with an address change request will be passed to the customer.

Title to Goods.

Laws concerning the sale and shipping of alcoholic beverages are complex and vary from State to State. Accordingly, you will be the legal owner of the goods when your funds have been processed and received, and all or any holds have been cleared.

Title to all alcoholic beverages purchased on this Site pass to you in the State of California when the goods are picked up by the common carrier.

Shipping Laws.

You are responsible for abiding by all State and local laws, rules, and regulations of your State pertaining to the receipt of alcoholic beverages from out of state.

You additionally represent you have obtained any required permission, paid any required fees, are working through properly licensed intermediaries where required, and are legally entitled to take possession of the alcoholic beverages.

You further represent you are legally entitled to take possession of the quantities ordered, and that you and the person accepting delivery of the alcoholic beverages are at least 21 years of age.

By making a purchase on our Site, you are asking us to appoint a common carrier and arrange for transportation on your behalf for the delivery of alcoholic beverages and any other purchased merchandise to you.

By making use of this service from Old Town Tequila, you are acting in agreement with your local and State laws regarding the purchase, transportation, and delivery of alcoholic beverages.

Accordingly, we make no representations or warranties concerning the legal requirements of shipping alcoholic beverages to your State; our Website merely provides a list of those States where common carriers have indicated their willingness to deliver alcohol.

As such, you understand and acknowledge you are accountable and liable for compliance with all laws concerning such shipments to your State, and you further agree to indemnify and hold harmless Old Town Tequila, and its personnel, from any and all claims, demands, damages, liability whatsoever, whether in tort, contract, or otherwise, arising out of the shipment of alcoholic beverages to your State, including any and all claims that such shipment may violate any federal, state, or local regulation pertaining to the sale and shipment of alcoholic beverages.

Shipment Method, Timing and Delivery.

Our products are shipped from Southern California. While Old Town Tequila tries to make every effort to fulfill orders at a reasonable speed, a typical order can take an average of 1-5 days to ship. However, please allow at least 8-10 days for delivery.

Shipping charges are calculated based on weight, destination, and delivery method.

All products delivered must be signed by an adult over the age of 21. Deliveries will not be left at any address or with any individual without such signature.

You are responsible for checking your order immediately upon delivery. Items must be reported as missing or incorrect within three (3) business days from the date of delivery.

In the event an incorrect item was shipped, you must submit a photo of the sealed bottle along with your receipt or order number in an email to Old Town Tequila. If you are not contacted by us for any reason within 14 days of your email, please send another email.

Failed Delivery Attempts.

If you fail to receive your order after the allocated number of attempts of delivery under the shipping agency’s policies, and the product is sent back to Old Town Tequila, a ten percent (10%) restocking fee will be deducted from your refund.

Shipping costs will not be refunded.

If the product in question was initially shipped free of charge due to any promotions, we will deduct the shipping fee from the refund for shipping and handling.

If the package is returned to Old Town Tequila damaged because of failed delivery attempts or refusal of delivery, you are responsible for the full cost of the order.

Damaged Items.

While Old Town Tequila takes every precaution to ensure your order is packaged properly and arrives safely. All orders are shipped in durable boxes and packaged with layers of wrapping in order to protect the bottles.

Orders that include original packaging from the manufacturer or contain non-conventional shaped bottles may be packed differently, but securely in the sound business judgment of our shipping department.

During times of extreme weather conditions, you are responsible for notifying Old Town Tequila of any special request to hold and postpone your order.

However should any product be damaged during shipping, please email pictures to info@oldtowntequila.com.
(excludes taste, spillage/Leaks, minor damage and/or cosmetic defects.)

Limitation of Liability.

Old Town Tequila will not be liable under any legal theory, whether in tort (including negligence), contract, or otherwise, for any incidental, consequential, indirect, special, or punitive damages arising out of your access to or use of the Website, regardless of whether Old Town Tequila has been advised of the possibility of any such damages.

OLD TOWN TEQUILA RESERVES THE RIGHT TO CHANGE ANY INFORMATION CONTAINED ON THE WEBSITE AT ANY TIME AT ITS SOLE AND ABSOLUTE DISCRETION.

IF YOU DO NOT AGREE WITH ANY OF THE TERMS AND CONDITIONS OF THIS WEBSITE, OR ANY CONTENT CONTAINED THEREIN, DO NOT USE THIS WEBSITE.

YOUR SOLE AND EXCLUSIVE REMEDY AGAINST OLD TOWN TEQUILA IS TO DISCONTINUE USE OF THE SITE AND DAMAGES AGAINST OLD TOWN TEQUILA SHALL BE LIMITED TO THE DOLLAR VALUE OF THE ORDER PLACED BY YOU.

Force Majeure.

We will not be deemed to be in default of or to have breached any provision herein as a result of any delay, failure in performance or interruption of service, resulting from acts of God, acts of civil or military authorities, civil disturbances, wars, strikes or other labor disputes, fires or other catastrophes or occurrences which are beyond Old Town Tequila’s reasonable control.

All sales are final. If you need to cancel an order that has not yet been packaged or shipped a refund may be issued at our discretion and a ten percent (10%) restocking fee may be applied.

Legality and Validity.

If any of these terms and conditions (or any portion thereof) or the application of any such provision (or any portion thereof) to any person or circumstance shall be held invalid, illegal or unenforceable in any respect by a court of competent jurisdiction, such invalidity, illegality or unenforceability shall not affect any other provision hereof (or the remaining portion thereof) or the application of such provision to any other persons or circumstances, and the parties shall endeavor to fulfill the intent of the severed provision to the extent permitted by law.
